Terms of Service

Welcome to Hello DJ. These Terms of Service ("Terms") govern your access to and use of the Hello DJ mobile application and web platform (the "Service"), operated by Hello DJ ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Service Description

Hello DJ is a platform that connects DJs with patrons at bars, venues, and events. Through the Service, patrons can submit song requests, send messages, and make monetary offers to DJs by scanning a QR code. DJs receive these requests in real time and can accept or reject them. The Service facilitates secure payments between patrons and DJs, with venues optionally participating in the revenue model.

Platform Fee

Hello DJ charges a platform fee of 20% on all transactions processed through the Service. This means DJs receive 80% of every song request, tip, and offer amount. The platform fee covers payment processing, infrastructure, support, and ongoing development of the Service. We reserve the right to modify the platform fee with 30 days' prior notice to affected users.

User Accounts and Responsibilities

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your account credentials and not share them with others.
• Notify us immediately of any unauthorized use of your account.
• Accept responsibility for all activity that occurs under your account.
• Be at least 18 years old or the age of majority in your jurisdiction.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

Payment Terms

All payments on Hello DJ are processed through Stripe and Stripe Connect. By using the payment features of the Service, you also agree to Stripe's Terms of Service.

• Patrons: payments are charged immediately upon submitting a song request or offer. Accepted payment methods include credit/debit cards, Apple Pay, and Google Pay.
• DJs: earnings are deposited automatically to your connected Stripe account. Payout timing depends on your Stripe account settings and region (typically 2–7 business days).
• Refunds: if a DJ rejects a song request, the patron will receive an automatic refund. Refund processing times depend on the payment method and issuing bank.
• All amounts are displayed and processed in the currency configured for the DJ's session.

Prohibited Content and Behavior

You agree not to use the Service to:

• Submit song requests or messages containing hate speech, threats, harassment, or discriminatory language.
• Send obscene, offensive, or sexually explicit content through messages.
• Impersonate another person, DJ, or venue.
• Engage in fraudulent transactions, including chargebacks made in bad faith.
• Attempt to circumvent the platform fee or payment system.
• Use automated bots, scrapers, or other tools to interact with the Service.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Violate any applicable local, state, national, or international law.

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines at our sole discretion.

Intellectual Property

The Service, including its design, logos, code, and content, is owned by Hello DJ and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written consent.

Song requests submitted through the Service reference third-party music. Hello DJ does not host, stream, or distribute copyrighted music. DJs are responsible for ensuring they have appropriate licenses to perform music at their venues.

Limitation of Liability

To the fullest extent permitted by applicable law, Hello DJ and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Service.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee that:

• The Service will be uninterrupted, timely, secure, or error-free.
• Any DJ will accept a particular song request or offer.
• The results obtained from using the Service will be accurate or reliable.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at our sole discretion, without prior notice, for conduct that we believe:

• Violates these Terms or any applicable law.
• Is harmful to other users, DJs, venues, or the Service.
• Involves fraudulent or abusive behavior.

Upon termination, your right to use the Service will immediately cease. Any pending payouts will be processed in accordance with Stripe's policies, minus any amounts owed for chargebacks or disputes.

Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.

Changes to These Terms

We may revise these Terms at any time by posting the updated version on this page and updating the "Last updated" date. For material changes, we will provide notice through the Service or via email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
